ATTORNEY SAMIR PATEL SECURES ACQUITTAL FOR CLIENT IN WOODEN BOX CHILD CRUELTY AND FALSE IMPRISONMENT CASE. |

Attorney Samir Patel secures an acquittal for client in the wooden box child cruelty and false imprisonment case. Mr. Patel represented the step-mother who, along with the child’s father, was alleged by the District Attorney to have placed their 8 year old child in a small poorly ventilated wooden box as a method of corporal punishment. The father and step-mother were both charged with 9 counts consisting of charges including cruelty to children first degree, cruelty to children second degree, and false imprisonment. The father was convicted of six of the nine counts charged against him in which Judge D. Scott Smith told the father, “[t]his is one of the most troubling cases I've ever sat through.” However, Mr. Patel was able to secure an acquittal for the firm’s client.

On March 23, 2011, Partner John T. Mroczko successfully litigates a will contest case in Gordon County where the Judge of the Probate Court denies admitting a will to probate. The caveat (objection to a will) alleged undue influence and lack of execution in the proper formalities under Georgia law. In this case, the testator was an elderly blind man who was unduly influenced by a spouse to execute a will. After the testimony, the Probate Court denied admitting the will to Probate. |

Partner John T. Mroczko helped a disabled client recover a fifty acre family farm and money damages in Gordon County Superior Court. Mr. Mroczko brought an action on behalf of his client alleging fraud, undue influence, intentional interference with inheritance and breach of fiduciary duty. Mr. Mroczko was able to negotiate a settlement whereby his client recovered the entire family farm and money damages. |
